Access to Courts for Individuals who are Deaf or Hard of Hearing

Recently, we have received a variety of questions regarding the obligation of a state or federal court to provide a sign language interpreter to someone who is deaf or hard of hearing. Pennsylvania Administrative Rule of Court 1903 requires that upon request, the state court provide and pay for a sign language interpreter that is necessary for any party, witness or juror who is deaf. Further, The Committee on Court Administration and Case Management for the Federal Court system has determined that courts must provide sign language interpreters or other auxiliary aids to deaf and hearing impaired participants in Federal Court proceedings. These services are to be provided without cost to the participants
